This agreement is between you and Chad Wallace (“Licensor”) for the Concrete Evap Pro app (“the App”). By downloading or using the App, you agree to these terms. If you do not agree, do not use the App. See also the Privacy Policy.
1. License
Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not copy, modify, reverse engineer, rent, lease, or redistribute the App.
2. Purpose and professional judgment
The App estimates the rate of evaporation from fresh concrete surfaces from the values you enter. The results are estimates only. They are a planning aid and do not replace engineering judgment, project specifications, agency requirements, or on-site measurement. You are solely responsible for decisions made using the App’s results, including placement, curing, and acceptance of concrete.
3. Disclaimer of warranties
The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or uninterrupted.
4. Limitation of liability
To the fullest extent permitted by law, Licensor is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from use of or reliance on the App, including construction defects, rework, delay, or lost profits. Licensor’s total liability for any claim will not exceed the amount you paid for the App, or US $10 if the App was free.
5. Advertising and privacy
The App does not display advertising and contains no advertising or tracking software. Our Privacy Policy describes how information is handled and is part of this agreement.
6. Termination
This license ends automatically if you break these terms. On termination, delete the App.
7. Apple
This agreement is between you and Licensor only, not Apple. Apple has no duty to provide maintenance or support for the App. If the App fails to meet a warranty, you may notify Apple for a refund of any purchase price; Apple has no other warranty duty for the App. Licensor, not Apple, is responsible for any claims about the App, including product liability, legal compliance, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
8. Changes
We may update these terms. Continued use of the App after an update means you accept the updated terms.
9. Governing law
These terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules.
